MissionStack terms of use
Terms of use
The rules for using MissionStack, in plain words. Apple's Standard EULA is your licence to the app; these terms cover the rest.
The short version
- MissionStack plans your training on iPad and Mac and shows your live workout on a big screen.
- Your plan lives on your iPad or Mac and belongs to you. There’s no account, and nothing is sent to us.
- The board is a screen other people in the gym can see. Choose where you put it.
- Lifting is risky. Train within your limits and check with a doctor when in doubt.
- This short version is a summary. The full terms below are what count.
1. Who we are
MissionStack is made by Mission Built (“Mission Built”, “we”, “us”), which is Mike Nichols, in Pittsburgh, Pennsylvania, USA.
Email: [email protected].
2. Agreeing to these terms
By downloading, opening or using MissionStack, you agree to these terms and to the MissionStack Privacy Policy. If you don’t agree, don’t use the app.
You got MissionStack from Apple’s App Store, so Apple’s Licensed Application End User License Agreement (the “Standard EULA”, https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. The Standard EULA is your licence to the app. These terms add the rules for the board, training and everything else the Standard EULA doesn’t cover. If the two conflict on the licence itself, the Standard EULA wins. On everything else, these terms win.
3. Who can use MissionStack
You must be at least 18, or the age of majority where you live if that’s higher, to use MissionStack.
MissionStack isn’t made for or directed at anyone under 18.
If you use MissionStack for an organisation, such as a gym or a team, you confirm you’re allowed to accept these terms for it.
4. Your licence to use the app
We give you a personal, non-exclusive, non-transferable, revocable licence to use MissionStack on Apple devices you own or control, as the App Store’s Usage Rules allow. We keep all other rights.
MissionStack is not open source. Unless the law lets you do it anyway, you may not:
- copy, modify, translate or make derivative works of the app;
- reverse engineer, decompile or disassemble it, or try to extract its source code;
- rent, lend, sell, sublicense or redistribute it;
- remove or change any copyright, trademark or other notice in it.
5. Your data and your files
Your plan, its workouts and your settings are stored on your iPad or Mac. They’re yours. We don’t claim any ownership of them. MissionStack has no account and sends nothing to Mission Built.
You can export your plan at any time, in the Mission Built Schema, a documented file format, and import files in that format. An import is only as good as the file. Check what it shows before you bring it in.
Your device holds the only copy of your plan unless you back it up. Keep backups (iCloud or computer backup, or regular exports). We can’t recover a plan that was only on a device that’s lost, wiped or broken.
The Privacy Policy says what MissionStack keeps, what the board shares on your Wi-Fi and how to delete it all.
6. The board
The board shows a workout from IronStack on your iPhone on this iPad, Mac or Apple TV. It connects to your iPhone over your own local network, encrypted, after you pair the two with a code. It keeps nothing once the workout ends; your workout is saved on your iPhone.
- A board is a screen other people can see. What it shows (your exercise, sets, loads, rest clock and records) is visible to anyone in the room. Put it where you’re happy for that to be seen, and close it when you’re done.
- Pair only your own phone, or a phone whose owner has said yes. Forget a phone you no longer use (the Privacy Policy says how).
- Use the board on networks you trust. It works on your local network only, and you’re responsible for that network.
- The board is an aid. It shows what your phone sends. Check the plates on the bar and your logged sets yourself.
7. Features that talk to Apple
MissionStack uses the local network (for the board), the Camera on your iPhone (to scan the pairing code; IronStack or Apple’s Camera app does that, not MissionStack) and speech for the board’s voice cues. Apple’s own terms and privacy policy cover Apple’s services.
8. Training is risky. Your safety is on you.
Strength training can cause injury, including serious injury and, rarely, death. By using MissionStack you accept that risk for yourself.
- See a doctor before you start or change a training program, especially if you have a heart, blood-pressure, joint or other medical condition, are pregnant, or haven’t trained in a while.
- Stop if you feel pain, dizziness, chest pain or shortness of breath, and get medical help.
- Use safe setups. Use safety arms, collars and spotters where they make sense, and gear you know how to use.
- The rest clock, the board and a plan are aids. Check the plates on the bar yourself.
- Typed lines and imports can be read wrong. Check the sets they fill in before you train them.
MissionStack is a planning and display tool. It’s not a medical device and doesn’t diagnose, treat or prevent anything.
9. Beta, feedback and ideas
TestFlight builds are unfinished. They may crash, lose data, change or stop working. Export your plan often while you test.
If you send us feedback or ideas, we may use them without owing you anything. We’ll never publish your name with them without asking.
10. Price
Nothing in MissionStack is for sale. It’s free during the TestFlight beta, and the launch price isn’t set. If something is ever sold, it will be through Apple’s in-app purchase, with Apple’s terms for billing and refunds, and these terms will say how before it applies.
11. Third-party services
MissionStack relies on Apple (the App Store, iPadOS, macOS, tvOS, and the networking and speech the board uses). We don’t control Apple’s services. If one changes or stops, a feature may change or stop too.
12. Ownership and trademarks
The app, its design, text, sounds and code belong to Mission Built or its licensors. Open-source parts are under their own licences, listed on the acknowledgements page.
IronStack, MealStack, MissionStack, Mission Built, MISSION ▪ BUILT, the barbell mark, the oxblood-square mark and the app icons are trademarks of Mission Built LLC. You may not use them without written permission, except to refer to the apps by name.
The Mission Built Schema, the file format, is documented so anything can read and write it. Writing a file in that format doesn’t give you rights to the marks above.
13. Changes to the app
We improve MissionStack often and may add, change or remove features. We’ll try to keep your plan readable and exportable through any change. We don’t promise that any feature, including the board, will always be available.
14. Ending these terms
You can stop at any time by deleting the app. Use Delete all data in MissionStack’s settings first if you want the phones the board remembers forgotten too (the Privacy Policy explains why).
We may end your access to the app if you break these terms, if the law requires it, or if continuing would put people, us or the service at risk. Where it’s reasonable, we’ll tell you why.
When these terms end, your licence ends. Sections 5, 8, 12 and 15 to 20 survive.
15. No warranty
MissionStack is provided “as is” and “as available”. To the fullest extent the law allows, Mission Built disclaims all warranties, express or implied. That includes merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the app will be uninterrupted, error-free or keep your data safe.
Some places don’t allow these exclusions. If you live in one, the exclusions apply only as far as the law allows, and you keep the rights your local law gives you.
16. Limits on our liability
To the fullest extent the law allows:
- Mission Built isn’t liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, profits or goodwill, arising from MissionStack or these terms. This applies even if we were told such damage was possible.
- Mission Built’s total liability for all claims is limited to the greater of (a) what you paid us for MissionStack in the 12 months before the claim, or (b) US $50.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit.
17. Your responsibility to us
If you break these terms or the law and a claim is brought against Mission Built because of it, you agree to cover Mission Built’s reasonable losses and costs from that claim. This applies only as far as the law allows. It doesn’t apply to consumers where local law forbids it.
18. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws rules. Disputes go to the state or federal courts in Allegheny County, Pennsylvania, and you and we agree to their jurisdiction.
If you’re a consumer in the EU, the UK or another country whose law gives you the right to bring a claim at home, or to rely on its mandatory consumer protections, nothing here takes that away.
Before filing anything, please email [email protected]. Most problems get fixed faster that way.
19. Apple
These terms are between you and Mission Built, not Apple. As far as these terms act as an end user licence agreement:
- Apple isn’t a party. Mission Built, not Apple, is solely responsible for MissionStack and its content.
- Scope. The licence is limited to a non-transferable licence to use MissionStack on Apple-branded products you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions allow. Other accounts associated with the purchaser may access it through Family Sharing or volume purchasing.
- Support. Mission Built alone provides maintenance and support. Apple has no obligation to provide any.
- Warranty. Mission Built is responsible for any product warranty that can’t be disclaimed by law. If MissionStack fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for MissionStack. Any other claims, losses, liabilities, damages, costs or expenses from a failure to meet a warranty are Mission Built’s responsibility.
- Product claims. Mission Built, not Apple, is responsible for any claims by you or a third party relating to MissionStack or your use of it. This includes (a) product liability claims, (b) any claim that MissionStack fails to meet a legal or regulatory requirement, and (c) claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that MissionStack or your use of it infringes their intellectual property rights, Mission Built, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that (a) you’re not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and (b) you’re not on any US Government list of prohibited or restricted parties.
- Contact. Questions, complaints or claims about MissionStack go to Mission Built, Pittsburgh, Pennsylvania, USA, [email protected].
- Third-party terms. You must follow any applicable third-party terms when you use MissionStack.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
20. The rest
- Whole agreement. These terms, the Privacy Policy and Apple’s Standard EULA are the whole agreement between you and us about MissionStack.
- Severability. If a court finds any part unenforceable, the rest still applies.
- No waiver. If we don’t enforce something straight away, we can still enforce it later.
- Assignment. You can’t transfer these terms. We can transfer them to a successor, for example a company Mission Built forms, or a buyer of MissionStack. We’ll tell you if that happens.
- Export. You’ll follow US export and sanctions laws when you use MissionStack.
21. Changes to these terms
If we change these terms, we’ll post the new version here with a new effective date. If a change matters, for example new fees or a change to how the board works, we’ll tell you in the app before it applies. If you keep using MissionStack after that, you accept the new terms. If you don’t agree, stop using the app and delete your data.
